T&C and Terms of Messaging – Get Rizing Leads / Rizing LLC

1. Acceptance

By using our website, services, or consenting to messaging from Get Rizing Leads, you agree to these Terms & Conditions, including any messaging terms and our Privacy Policy.

2. Services & Messaging

• We provide re-engagement messaging (SMS, email) and related services to re-contact past customers or contacts you supply.

• You must supply valid, consented contact lists and ensure compliance with local laws.

• You acknowledge that SMS may incur carrier or data charges.

3. Messaging Compliance & Use

• All messages must comply with applicable laws, including TCPA, CTIA, and local SMS regulations.

• You will not use this service for disallowed content such as high-risk financial services, debt collection, get-rich-quick schemes, credit repair, affiliate lead generation, or other categories disallowed under A2P 10DLC. (Twilio error code 30897 is triggered by disallowed content types such as lead-gen or risk investment).

• Messages must clearly identify Get Rizing Leads (or Rizing LLC) as the sender.

• Every message must include an opt-out instruction, such as “Reply STOP to unsubscribe.”

• You may not send additional marketing messages after a confirmed opt-out.

4. Consent & Opt-Out

• You must obtain express, written consent from each recipient before sending messages.

• Consent must be documented, timestamped, and retained for audit.

• You agree to respond to opt-out requests immediately and stop further messaging to that number.

5. Intellectual Property

All content, design, trademarks, and software on our site and services are owned by Rizing LLC. No license to use is granted except as needed to interact with the service.

6. Limitation of Liability

To the fullest extent allowed by law, Rizing LLC will not be liable for losses, damages, or liabilities arising from use of our services or messaging, even if foreseeable.

7. Termination

We or you may terminate access at any time. After termination, existing obligations such as opt-out processing, data retention, and liability limitations remain in force.

8. Governing Law

These Terms are governed by the laws of [Your State, e.g. Washington State], without regard to conflict of law rules.

SMS Terms & Conditions Addendum

By opting into SMS messaging from Get Rizing Leads (Rizing LLC), you agree to the following terms:

1. Messaging Program

You consent to receive SMS text messages from Get Rizing Leads for reengagement purposes, offers, and service updates related to past services you have used.

2. Message Frequency

Message frequency may vary based on your interaction. You may receive occasional messages (e.g., 2–4 per month) unless you unsubscribe.

3. Message & Data Rates

Standard message and data rates may apply from your mobile carrier when sending or receiving SMS messages.

4. Sender Identification

All messages will clearly identify Get Rizing Leads (Rizing LLC) as the sender.

5. Opt-Out / Unsubscribe

You can unsubscribe from SMS messaging at any time by replying STOP to any message. You will receive a confirmation that you have been unsubscribed, and no further promotional messages will be sent.

If you’d like to subscribe again, you must opt in again via our website form.

7. No Liability for Delivery Issues

We do not guarantee that all messages will be delivered. Delivery may be affected by network conditions, carrier filters, or device issues.

8. Agreement & Changes

Your consent to receive messages constitutes your agreement to these SMS terms. We reserve the right to modify these terms at any time; changes take effect when published. Continued use of our SMS services after changes means you accept those changes.
